1.1 These User Terms (hereinafter referred to as “the User Terms”) for Holdsport.dk govern the relationship between the users and Holdsport.dk (hereinafter simply referred to as “Holdsport”).
1.2 By continuing to use Holdsport.dk and associated services, you accept the User Terms. If you do not accept the terms, you must cease use of Holdsport.dk and associated services.
1.3 By accepting the User Terms, you give your consent to Holdsport.dk, which allows Holdsport to process your data.
1.4 If you are under 16 years of age, you must have your parents' approval to accept the User Terms and to give consent to Holdsport.
1.5 You are recommended to save and/or print the User Terms.
1.6 Holdsport is an online tool for the coordination of all types of team sports and other types of sports or activities.
1.7 Holdsport is operated by:

2.2 See Holdsport's handling of personal data in Holdsport's Personal Data Terms further down in this document.
2.3 It is your own responsibility that the information in your user account is correct and up to date. Holdsport has no responsibility for consequences of incorrect information in the user account.
2.4 In connection with the creation of a user account, you must choose a password. Your password is personal, and you must treat it confidentially.
2.5 If you experience misuse of your password or user account, you must immediately contact Holdsport at the e-mail address specified above.
2.6 By your acceptance of these terms, you consent to Holdsport being able to send informational e-mail to the e-mail address that you have attached to your user account on Holdsport, or via any other communication channel that you have signed up for via your profile.
2.7 By your acceptance of these terms, you consent that, if your club uses Holdsport's organisation hat to send out e-mails, or messages via any other communication channel that you have signed up for via your profile, you may receive these from, for example, an association or federation of which your club is a member.
2.8 Such communication may, subject to your separate consent, contain advertising material.
3.1 If you wish to delete your user, this can be done under your ‘Profile settings’. In the event of deletion, special terms exist for possible scenarios. These are elaborated in Holdsport's Personal Data Terms.
3.2 Deletion of your user requires an active action from your side. Your user will remain in Holdsport's database until you actively delete the user.
3.3 If you are affiliated with a club, e.g. as a member, or as a participant on a team, the club will – on the basis of your affiliation with the club – have a range of information about you. This may also relate to Holdsport, since the club, via their agreement with Holdsport, may have information about you, and via your affiliation with the club, the club may have handed over information about you to Holdsport, e.g. in order to be able to collect payment for participation on a team. You must contact your club for deletion of this information.
4.1 Holdsport holds all rights, including ownership rights, trademarks and copyright, to Holdsport.dk, and to the software attached to the service.
4.2 By accepting the terms, you obtain a time-limited, non-exclusive and revocable right to use Holdsport, as made available on the internet or via our app. The right of use is conditional on your continuous acceptance of the terms in force from time to time, including the User Terms, for Holdsport. If you cannot accept such terms, you must immediately cease use of Holdsport.
4.3 In order to ensure fast and precise communication and support of you as a user, Holdsport may use automated tools, including OpenAI's ChatGPT and related tools, to analyse and answer inquiries from you and other users. We use the dialogue with all users as a basis for developing these tools. The dialogue with you is anonymised. As a user, you consent to this use.
4.4 To the extent that you upload material to Holdsport.dk or via Holdsport's app, you grant Holdsport a right of use to such material so that Holdsport can carry out its services. You warrant that you have the necessary rights to be able to grant Holdsport such a right of use.
4.5 The following rules apply when you upload material to Holdsport.dk, via our app, or via a website belonging to a club with which you are affiliated, which Holdsport administers:
To the extent that Holdsport is held liable for your actions in relation to the above, e.g. for breach of copyright, you as a user shall indemnify Holdsport in every respect, including by paying for rights and for the time spent by Holdsport handling the infringement.
4.6 In the event of repeated and/or serious violations of the rules, your profile may be deactivated, and in serious repeat cases your profile will be deleted. We reserve the right to store sufficient information to ensure that a deleted profile / user cannot create a profile again. If you believe that you have been unjustifiably deleted or deactivated, you must contact Holdsport at info@sportmember.com.
5.1 If you as a user attach the possibility of receiving and sending payments from your user account, please be aware that this takes place on the basis of an agreement that you enter into with a third party, e.g. a club or another user. Holdsport's solutions contain a number of services that involve payments, e.g. Holdsports Billetportal, Holdsports Klubshop etc. As a user, you must accept the terms that apply to these services if you wish to use them. When using all other services, e.g. “payment activity” etc., by accepting these User Terms you accept that you may pay or receive payments via these services. This takes place without supplementary acceptance of other terms.
5.2 Via Holdsport, it is possible to purchase the right to participate in teams in Clubs that have entered into an agreement with Holdsport in this respect. The terms for this appear immediately below, and they govern the relationship between you as a user of Holdsport who creates, renews or otherwise acquires the right to participate in a team in a sports association, sports club etc. that via Holdsport offers participation in such teams (hereinafter referred to as “the Club”). The terms are accepted by you as a user upon the purchase of team participation via Holdsport. If you do not accept the terms, the purchase of team participation cannot be made.
5.3 The agreement on participation in a team is entered into directly between you and the Club, but is sold via Holdsport. Holdsport is thus not a party to your agreement on participation in a team. Holdsport merely facilitates such right to participate in specific teams on behalf of the offering Club. By purchasing the right to participate in a team via Holdsport, you approve the terms for participation in the team in question which are referred to in connection with the purchase of participation in the team in question. These may be terms or conditions set by the Club. In order for an agreement to be entered into between you and the Club, Holdsport passes on information about your name, address and date of birth to the Club. If Holdsport, by agreement with the Club, is to pass on other information to the Club, you will be informed of this.
5.4 Price, period (e.g. season or the like) and other material information regarding the team in question, as well as any conditions for participation in the team, appear on Holdsport upon ordering. After the purchase of the right to participate in a team via Holdsport, you receive proof of such right. The proof is sent to the e-mail address you have provided, or via any other communication channel that you have signed up for via your profile. You must save and, where appropriate, print the proof, which must be redeemed at the Club no later than upon your first participation on the team.
5.5 Payment can only be made with the payment methods used by Holdsport. The handling of payment cards takes place via an approved provider, and communication is encrypted. For each debit of payment from you, a payment fee is imposed. The fee will either appear in connection with the payment, or it will be able to be provided by the Club. If payment with the payment method you use is, for one reason or another, not carried out, and this can be attributed to your circumstances, e.g. lack of funds, Holdsport is entitled to send you a reminder letter. For each such reminder letter, a reminder fee of DKK 100 is imposed. In the event of late payment, default interest accrues on the outstanding amount in accordance with the Danish Interest Act, from the due date until payment is made.
5.6 If the payment for the right to participate in a team is divided into several instalments, this will be stated in connection with ordering. The right to participate in the team purchased via Holdsport in that case only grants the right to participate in the team for the period for which payment has been made, e.g. the first month of the autumn season. Upon registration for a team over several seasons, e.g. if you regularly participate in a team, year after year, Holdsport collects payment for such participation on an ongoing basis in accordance with the Club's instructions. As a user, you accept that payment may take place on an ongoing basis in accordance with your agreement with the Club.
5.7 As a user, you have a right of withdrawal for a period of 14 days after receipt of proof of the right to participate, to the extent that legislation grants you this right. Withdrawal must be notified to Holdsport in writing. Contact information is provided below. The notification must have been sent no later than at the time of the expiry of the right of withdrawal. If the proof has been redeemed, e.g. upon first participation on the team in question, the purchase of the right to participate via Holdsport can no longer be withdrawn, regardless of whether the withdrawal period has expired or not. If the right of withdrawal is exercised in a timely manner, Holdsport will refund, as soon as possible and no later than after 14 days, all payments received from you regarding the withdrawn purchase of the right to participate on the team. Any inquiry regarding purchases on Holdsport.dk, including in connection with withdrawal, is to be directed to: info@sportmember.com.
5.8 You are urged to check that the correct team and period are stated in the proof. If there are errors or defects in the proof sent, you must contact the Club or Holdsport, which will then remedy the defect. If there are errors or defects in the team for which you have purchased the right to participate via Holdsport, including if the team does not live up to what was expected, you must immediately contact the Club, which is responsible for the team for which the right to participate is sold via Holdsport. Holdsport assumes no liability towards you on the occasion of errors, defects, or the team for which you via Holdsport have acquired the right to participate otherwise not living up to what was expected.
5.9 Holdsport is entitled, shortly before expiry of the period for which you have purchased the right to participate on a team via Holdsport, to contact you by e-mail, or via any other means by which you have accepted to be contacted, for the purpose of reminding you to remember to purchase the right to participate on the team for the coming period. Holdsport is not, however, obliged to do this. If you have consented to ongoing payments, e.g. payment of ongoing membership fee collections or subscriptions, these collections may be carried out without further notice. See also section 5.6 above.
6.1 Holdsport.dk and Holdsport's services are made available as they are and are available in the form applicable from time to time. Holdsport endeavours to keep the services available at all times, but does not guarantee this. Holdsport cannot be held liable for lack of access to Holdsport.dk and other services, other operating disturbances, system breakdowns or the like, regardless of whether Holdsport could have avoided them.
6.2 Any use of Holdsport.dk and Holdsport's other services takes place at your own responsibility and at your own risk. Holdsport can in no event be held liable in damages for your use of Holdsport.dk or for lack of access to the service.
6.3 Holdsport.dk is not liable for the accuracy or completeness of information found on Holdsport.dk, and is in no case liable for losses arising on the basis of actions or omissions carried out in reliance on the information appearing on Holdsport.dk or the lack thereof. Furthermore, Holdsport is never liable for data, information and the like appearing on internet pages to which Holdsport.dk links.
6.4 Holdsport can in no event be held liable in damages for indirect losses, including but not limited to consequential damage, lost earnings, operating loss, loss of data or other losses at you as a user or at a third party.
6.5 If Holdsport, notwithstanding the above limitations of liability, should become liable in damages, Holdsport's liability is at all times limited to an amount corresponding to that which you as a user have paid for the use of Holdsport within the last 6 months prior to the loss arising, but never more than a total amount of DKK 1,000.
6.6 Holdsport can in no event be held liable for indirect losses or consequential damage. Holdsport is otherwise, to the widest extent possible, without liability for all matters concerning payments or services.
7.1 Holdsport is at all times entitled to make changes to the User Terms. If Holdsport makes changes to the User Terms, you will be informed of this by the sending of an informational e-mail to the e-mail address provided, or you will be informed of this upon your next log-in.
7.2 If you do not accept the revised terms, you will not have the possibility of continuing to use Holdsport.
7.3 Holdsport is at all times entitled to make any changes to the service. This includes adding, deleting and changing functionality, or Holdsport may cease altogether to offer the service Holdsport.dk and associated services. All without any form of liability.
7.4 Holdsport will seek to give timely notice of changes and the like that are assessed to have a significant negative impact on you as a user.
8.1 Any dispute between Holdsport and you shall, as far as possible, be sought settled amicably.
8.2 If a dispute between Holdsport and you cannot be settled amicably, such matter shall be decided under Danish law by the ordinary Danish courts. To the extent that you may enter into such an agreement under applicable legislation, any lawsuit shall be brought before the District Court of Aarhus (Retten i Århus).
1.1 These Personal Data Terms for Holdsport.dk (hereinafter referred to as “the Personal Data Terms”) apply in relation to the processing of your personal data on Holdsport.dk and associated services, e.g. our app.
1.2 By continuing to use Holdsport, you accept the Personal Data Terms and give your consent to the processing described in the Personal Data Terms. If you do not accept the Personal Data Terms, you must cease use of Holdsport.
1.3 If you are under 16 years of age, you must have your parents' approval when you accept these terms and give your consent.
1.4 All personal data processed by Holdsport.dk is processed in accordance with the GDPR, which entered into force on 25 May 2018. The Danish Data Protection Agency (Datatilsynet) supervises any processing covered by the GDPR. See www.datatilsynet.dk.
1.5 You are recommended to save or print the Personal Data Terms.
1.6 In addition to these terms, our general privacy policy etc. applies. Holdsport.dk uses cookies. Reference is made to Holdsport's privacy policy and cookie terms.
2.1 If you are a member of a club or association that has accepted a data processing agreement between the club and Holdsport, the club is the data controller for the data use associated with the club's activities. This means that the club is responsible for ensuring that the rules under the GDPR are complied with to that extent. Furthermore, it is also the club's responsibility to inform about the purpose of the data processing.
2.2 In the event that you are not affiliated with a club that has signed a data processing agreement, Holdsport is the data controller for you and your data.
3.1 Holdsport is a data processor, and therefore acts on behalf of either you, or upon instruction from your club. In accordance with your rights as a user, Holdsport will follow your instructions in connection with, for example, withdrawal of consent or the like.
3.2 Holdsport shall take the necessary technical and organisational security measures to prevent information from being accidentally or unlawfully destroyed, lost or damaged, and to prevent it from being disclosed to unauthorised parties, misused, or otherwise processed in breach of the GDPR. Holdsport shall, upon your request, provide you with sufficient information to enable you to verify that the aforementioned technical and organisational security measures have been taken.
4.1 The purpose of processing your information is to ensure your ability to use Holdsport in connection with the teams for which you are registered, or to use those of our services that you wish. This gives, among other things, coaches and clubs with which you are affiliated the possibility to administer the teams for which you are registered. The legal basis for the data processing is article 6, paragraph 1, of the general EU GDPR.
4.2 In addition, Holdsport uses your information for marketing purposes, so that the advertisements you are presented with via Holdsport are, as far as possible, relevant to you. Non-personally identifiable information about your age, gender, sport and postal code is passed on to our partners. An overview of our partners can be seen when you access www.holdsport.dk in the first pop-up window you encounter. Your personally identifiable information and contact information are never passed on.
5.1 In connection with the creation of a team on Holdsport.dk, or via our other services, information about you is collected, either by you yourself providing this information on Holdsport.dk, via your club, via our other services, or by your coach providing information about you. At a minimum, information about your first and last name and your e-mail address is collected in this connection. From here, information about mobile telephone number, telephone number, date of birth and address information may additionally be optionally provided. As a user of our services, you accept that necessary data about you may be transferred between you, the club and Holdsport for the purpose of enabling you to participate in the activities related to you and the club. This is necessary since the purpose of our services – for you and the club as users – would otherwise be rendered impossible.
5.2 You always have the possibility of correcting the information provided about you at Holdsport yourself; see also section 7.2.
5.3 Holdsport also registers activities and events, including attendance registration, payments, registration of goal scorers etc.
5.4 Your club, as data controller, has the possibility of obtaining the desired information, which may include sensitive personal data about you. This is exclusively the club's responsibility, and the club must therefore also have a valid justification for this.
5.5 In order to ensure fast and precise communication and support of you as a user, Holdsport may use automated tools, including OpenAI's ChatGPT and related tools, to analyse and answer inquiries from you and other users. We use the dialogue with all users as a basis for developing these tools. The dialogue with you is anonymised. As a user, you consent to this use.
6.1 In the event that you choose to upload a profile picture to your profile, you consent to the club being allowed to use your profile picture on their website. You will always have the possibility of deleting or changing the image from your profile. If you do not wish to appear with a profile picture on the club's website, this can be opted out of under your ‘Profile settings’.
6.2 When you use Holdsport, you also give permission to appear on your club's internal Holdsport platform and on your club's website in situational photos taken in public spaces, including from matches held or the like.
7.1 As a user of Holdsport.dk, you have the right to obtain insight into the personal data that Holdsport processes about you. Furthermore, you are entitled to object to the processing that Holdsport, as data processor for your personal data, carries out. Holdsport does not process any information about you other than the information you can see on your user account.
7.2 If you discover that the personal data Holdsport processes about you is not correct or is misleading, you can rectify it. If it is not possible for you yourself to correct the information, you can contact Holdsport.
7.3 Any inquiry regarding insight into, rectification of, or objection to the processing of your personal data must be made to Holdsport via info@sportmember.com.
7.4 As a user of Holdsport, you have the right to receive the information registered about you. Under your ‘Profile settings’, you will find the function ‘Export data’, where all your personal data can be downloaded.
7.5 If you have been registered by your club, your user will be ‘Without consent’ until you yourself log in and actively give your consent to Holdsport. In the event that your club has registered you, it is the club's responsibility to obtain your consent to appear on Holdsport's platform.
7.6 You may at any time withdraw your consent. Withdrawal of consent means that you can no longer, or only to a very limited extent, use Holdsport.dk and associated services, e.g. our app. To withdraw your consent, you must delete your user under ‘Profile settings’. Special terms exist for deletion, cf. section 8.
8.1 When your coach or club deletes you:
8.1.1 Your coach or club has the possibility of deleting your affiliation with the team. In this scenario, your user will not be deleted from Holdsport. Your user will still be active and available for being affiliated with a new team or club.
8.1.2 If you thereafter wish to delete your user from Holdsport, this can be done under ‘Profile settings’.
8.2 When you delete your user, but your club still has justification for retaining your personal data:
8.2.1. Your club may have valid justification for storing your data, even if you delete your user. This applies in connection with the reporting of member numbers to the Central Association Register (Centralt Forenings Register). Your club has the right to passive storage of your information about your membership of the club for up to 3 years after the year of withdrawal, cf. article 17, paragraph 3, of the EU GDPR.
8.2.2. In connection with deletion, you will be offered the possibility of receiving newsletters from Holdsport and your club.
8.3 When you have been registered by your club without your active consent:
8.3.1 Some clubs use Holdsport as a member database. Your club may therefore register you as a ‘Without consent’ user. In this case, the Club is responsible for obtaining your consent to appear on Holdsport's platform. If you wish to be deleted from here, you must contact the Club.
8.4 When you delete your user, but you have arrears:
8.4.1 If you wish to delete your user, but have arrears in the form of membership fees or participation in payment activities, Holdsport reserves the right to store your personal data until the arrears have been paid.
8.4.2 If you are no longer a member of the Club, but you cannot delete your user due to a new membership fee payment, you must contact the Club. Holdsport can in this case not delete your user, since Holdsport cannot assess your membership of the Club.
9.1 Holdsport is at all times entitled to make changes to these Personal Data Terms. If Holdsport makes changes to the Personal Data Terms, you will be informed of this by the sending of an informational e-mail to the e-mail address registered under your user account, or you will be informed of this upon your next log-in.
9.2 If you do not accept the revised Personal Data Terms, you will not have the possibility of continuing to use Holdsport or associated services, e.g. our app.
